RSA 2023 Giveaway Terms and Conditions

TERMS AND CONDITIONS FOR GIVEAWAY

Please read these terms and conditions ("Terms and Conditions") carefully before participating in this giveaway ("Giveaway").

1. SPONSOR: The Giveaway is sponsored by Garner Products, Inc. ("Sponsor"), located at 10620 Industrial Ave., Suite 100, Roseville, CA 95678.

2. AGREEMENT TO RULES: By participating in the Giveaway, you agree to be bound by these Terms, which constitute a binding agreement between you and Sponsor. If you do not agree to these Terms, you are not eligible to participate in the Giveaway.

3. ELIGIBILITY: The Giveaway is open to legal residents of the United States who are 18 years of age or older at the time of entry. Employees, officers, and directors of Sponsor and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. Only one (1) winner per household is permitted. A household member shall mean people who share the same residence at least three (3) months a year. The Giveaway is subject to all applicable laws and regulations.

4. NO PURCHASE NECESSARY: No purchase is necessary to enter or win a prize. A purchase, if one is available, will not improve your chance of winning.

5. ENTRY PERIOD: The Giveaway begins on April 25, 2023, and ends on April 26, 2023 ("Entry Period"). All entries must be received by the end of the Entry Period. Sponsor reserves the right to extend or shorten the Entry Period in its sole discretion.

6. ENTRY: To enter the Giveaway, follow the instructions provided by Sponsor during the Entry Period. Participants must accurately complete all required fields, or the entry will be deemed incomplete and will not quality. Only one entry per person is allowed. Multiple entries by the same person will be disqualified.

7. PRIZE: The prize for the Giveaway is quantity one (1) watch on April 25, 2023, and quantity one (1) watch on April 26, 2023. No more than two (2) prizes will be awarded. The approximate retail value of the prize is $250 per watch. The prize is non-transferable, and no substitution will be made except as provided herein at the Sponsor's sole discretion. Conditions and restrictions may apply. Limit: One (1) prize per person/household. ALL PRIZES ARE AWARED “AS IS” AND THE SPONSOR DOES NOT MAKE (AND IS NOT RESPONSBILE FOR) ANY REPRESENTATIONS, GUARANTEES, OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO ANY PRIZE (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED.

8. WINNER SELECTION: The winner will be selected at random from all eligible entries received during the Entry Period. The winner will be notified by Email/Phone within seven (7) days following the winner selection. Sponsor is not responsible for and shall not be liable for late, misdirected or unsuccessful efforts to notify the winner(s). If the winner cannot be contacted, is ineligible, or fails to claim the prize within seven (7) days from the time the notification was sent, the prize will be forfeited, and an alternate winner will be selected. Potential winners are subject to verification, including verification of eligibility. If a Participant is unable to verify their information, the Participant will automatically be disqualified and their prize, if any, will be forfeited. The Sponsor reserves the right to determine an alternate winner in the event that any winner is disqualified, cannot be contacted, or is deemed ineligible for any reason, or is not available to participate in any applicable Giveaway events.

9. LIMITATION OF LIABILITY: BY ENTERING, PARTICIPANTS RELEASE AND HOLD HARMLESS SPONSOR AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL LIABILITY, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING PERSONAL INJURY) CAUSED BY PARTICIPATION IN THE GIVEAWAY OR THE ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE. SPONSOR IS NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY WEBSITE USERS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE GIVEAWAY OR BY ANY TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF SUBMISSIONS IN THE GIVEAWAY. UPON AWARDING THE PRIZE, THE SPONSOR WILL HAVE NO FURTHER OBLIGATION TO WINNER.

10. PUBLICITY: Except where prohibited, by accepting a prize, winner(s) grant the Sponsor permission to use their names, characters, images, and likenesses worldwide, in perpetuity, in any and all media now known or hereinafter invented in any and all marketing and promotional materials and waive any claims to royalty, right, or remuneration for such use. Each winner’s name may be included in a publicly available winners list.

11. PRIVACY: Any personal information submitted by participants will be subject to Sponsor's privacy policy. By entering the Giveaway, participants agree to receive email communications from Sponsor regarding the Giveaway and other promotions.

12. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend, terminate, and/or modify the Giveaway, or any part of it, for any reason or if in the sole discretion of Sponsor, if any fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Giveaway. Sponsor reserves the right in its sole discretion to disqualify and prohibit from participating (and void such person’s entries) any individual who tampers with the entry process. Sponsor's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.

13. CONDUCT AND DECISIONS: All decisions of the Sponsor will be final and binding on all matters relating to this Giveaway. Persons who violate any rule, gain unfair advantage in participating in the Giveaway, or obtain winner status using fraudulent means will be disqualified. The Sponsor will interpret these Rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Giveaway and the Sponsor’s decisions concerning such disputes shall be final. If, for any reason, more bona fide winners are notified than prize(s) available, prize(s) will be awarded in a random drawing from among all such persons. Inclusion in such drawing shall be each Participant's sole and exclusive remedy under such circumstances. Any reference in these Terms and Conditions or as part of the Giveaway to the Sponsor’s "discretion" and/or any exercise of discretion by the Sponsor shall mean in Sponsor’s "sole and unfettered discretion." The Sponsor further reserves the right to terminate the Giveaway at any time for any reason. 

14. LAW AND JURISDICTION: These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, in County of Placer, and any legal action or proceeding arising out of or related to these Terms and Conditions shall be brought exclusively in the courts of the State of California, in the County of Placer.
